Filing a patent at INNORPI: How to do? Which procedure?

 

  1. General Context :

All patent applications must be filed at the National Institute of Standardization and Industrial Property - INNORPI through the General Directorate of Research Valorization (DGVR) within the Ministry of Higher Education and Scientific Research (MESRS).

The requests are sent by hierarchical way to the Ministry of Higher Education and Scientific Research (General Directorate of the Valorization of Research).

It should be noted in this context that the Ministry of Higher Education and Scientific Research (General Directorate of Research Valorization) files the patent applications from the public institutions of higher education and research with the INNORPI and takes charge of the registration fees and the payment, upon request, of the first four annual fees.

 

The procedure consists of 4 steps:

  1. You make up and submit the application file, with all the supporting elements.
  2. INNORPI examines the file and gives an answer.
  3. Your patent is published if it is accepted.
  4. INNORPI grants you the patent 

 

  1. ​​ Composition of the file:

 

  • An application for registration of a patent to the attention of the Minister of Higher Education and Scientific Research signed by the director/dean of the institution.Faire une copie pour avoir la décharge

The following documents must be submitted in a sealed

envelope marked "DO NOT OPEN".

  • A request according to the new INNORPI model in triplicate which states the title of the invention, the name(s) and surname(s) of the holder (the institution of higher education and/or research) and its address, the name(s) and surname(s) of the inventor(s) and the name(s), surname(s) and address(es) of the representative: Note: the representative is Mrs. Rim Saied, Director General of the Valorization of Research at the Ministry of Higher Education and Scientific Research

 

  • A technical file in triplicate containing the following documents:
  • A description of the invention, which must be sufficiently clear and complete so that a person skilled in the relevant field of technology can implement it.
  • One or more claims (not exceeding 10) specifying the element(s) of novelty in the said invention, which shall be based on the description and indicate the scope of protection sought by the patent. Each claim is clearly and succinctly formulated in a separate sentence.
  • One or more drawings, if necessary for the understanding of the description.
  • A power of attorney on behalf of Mrs. Rim Saied, Director General of Research Valorization: Ministry of Higher Education and Scientific Research
  • Presentation sheet(s) of the inventor(s) to have the contact information in order to contact them if necessary
